By downloading, installing, accessing, or using the Choospark mobile application (referred to as "the App" or "the Service"), you agree to be bound by these Terms of Service (referred to as "Terms"). If you do not agree to these Terms, please do not download, install, or use the App.
These Terms constitute a legally binding agreement between you ("User" or "you") and the developers of Choospark.
Choospark is a utility decision-making tool. Its features include custom wheels, roll dice configurations, random number generator modules, coin flips, and list shuffling tools designed to help you resolve decision fatigue. The App is distributed as a free download, is 100% ad-free, and runs entirely in a local environment on your device.
To access premium features (including weight distribution, bulk import, unlimited wheels/presets, and random sorting tools), users can purchase the Pro Version Upgrade.
The Pro Upgrade is billed as a one-time product purchase of $3.99. It is NOT a subscription service. There are no recurring fees or automatic renewals associated with your purchase.
All in-app purchases are executed through Apple App Store (for iOS) and Google Play Store (for Android) official billing gateways. We do not process, receive, or store your billing data or card info.
Any refund requests, billing inquiries, or transaction discrepancies are subject to Apple's and Google's official App Store/Play Store merchant terms. Because billing operations are strictly managed by Apple and Google, we do not have direct control to initiate or process refunds on our end. You must request refunds via your Apple or Google account.
Because Choospark operates on a local-first paradigm, all of your data is stored exclusively in your device's memory/cache. We do not synchronise or backup your records on external cloud platforms.
We do not hold backups of your data. You acknowledge and agree that uninstalling the App, restoring your device to factory settings, clearing App-specific storage caches, or experiencing hardware loss or damage will lead to the permanent and irreversible loss of all your custom wheels, history logs, and lists. We shall not be held liable for any loss of local data.
The layout designs, graphics, branding identity (including names, logos, and iconography), code architectures, assets, and other content within Choospark are the intellectual property of the App's developers and are protected under copyright and trademark laws.
You are granted a limited, personal, non-transferable, and revocable license to use the App for non-commercial decision assistance. You must not reverse engineer, decompile, copy, modify, distribute, or create derivative works of any assets or source codes of the App without our express prior written permission.
The App is provided to you on an "AS IS" and "AS AVAILABLE" basis, with all faults and defects without warranty of any kind.
All tool outputs (spinning results, dice totals, sorted orders, randomized numbers, coin sides) are generated via software pseudo-random math modules for fun and helper purposes. We make no warranty regarding the outcome of any random decision generated by the App.
Under no circumstances shall the developer of Choospark be liable for any direct, indirect, accidental, or consequential damages, losses, conflicts, or disputes arising from your reliance on or execution of any random choices made using the App (e.g., resolving game nights, assigning house chores, choosing dinner locations, or making school/business choices).
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. When updates are published, we will revise the "Last updated" date at the top of this document. Continuing to access or use the App after any revisions become effective means you agree to be bound by the updated terms.
